The Verkhovna Rada of Ukraine has improved the mechanism of state registration of rights to immovable property and their weights.

For the law “On amendments to some legislative acts of Ukraine concerning improvement of state registration of rights to immovable property and protection of property rights” (№ 5067) as a basis and as a whole voted 271 MP.

The changes are aimed at improving the system of state registration of rights to immovable property. In particular, the mandatory immediate notification to the state registrars of the owner of the immovable property, on which the submitted statement on holding of the relevant registration procedures.

It is also introduced mandatory registration of the Declaration of ownership of the immovable property on the prohibition of the registration into the state register of rights.

According to the document, the restoration of the registration actions is only possible by a court decision which entered into legal force or the application of the owner.

The law also proposes to grant the right to the Ministry of justice of Ukraine to monitor the registration in the Unified state register of rights to immovable property.

In addition, the mandatory use of the state registrars of the statements of the State land cadastre and a Unified registry of documents that give right to perform preparatory and construction works.

The document has increased from 30 to 60 days the period of appeal against decisions, actions or inactivity of the state Registrar. The law also provides for the mandatory provision of paper extracts from the State register of rights.
